Methamphetamine Dealer Sentenced to 37 Months, Dec. 10

News release from SCINT. Richard Aaron Luck was sentenced to thirty-seven months in custody after entry of a guilty plea. The sentence stems from a May 2013 report to SCINT detectives of Richard Luck selling narcotics from a residence on Union Street in North Bend. It was also reported a child was subjected to this living condition. At the time of the report, an outstanding warrant existed for Luck. Based on the tip, SCINT detectives responded to the Union Street Address with the assistance of Coos County Parole and Probation and North Bend Police. Contact was made with a resident who initially denied Luck was present, despite officers seeing Luck through the doorway. Luck was contacted in the bedroom of his girlfriend, Danielle Kelly and immediately taken into custody. Luck was found with a large amount of currency on his person, which was inconsistent with his statements he was unemployed. Through interviews it was determined both Kelley and Luck exercised control over the room and items within, which included a Sentry Safe. A search of the room produced methamphetamine paraphernalia to include: clean bindles for packaging methamphetamine, methamphetamine smoking devices and used methamphetamine packaging. Further searching of the room evidenced a four year old child having ready access to the paraphernalia. A search warrant was obtained for the safe found in the room. Additional methamphetamine paraphernalia was found as well as the evidence proving sale and delivery of methamphetamine. This evidence included digital scales with residue, $1600, over 22 grams of methamphetamine. Luck was charged with Unlawful Delivery of Methamphetamine, Unlawful Possession of Methamphetamine, Child Neglect in the First Degree and Endangering the Welfare of a Minor. Luck set the matter for trial, then failed to appear for a court appearance on July 28th, 2014. A warrant was issued for Luck. In September 2014 Luck and Kelley were purportedly in a pursuit with Roseburg Police. The suspect vehicle crashed in Winston, OR. Danielle Kelley was arrested, but Luck evaded capture. Luck remained at large until a tip was provided to SCINT. Luck was reportedly hiding on property along Seven Devils Road in the Charleston area. With the assistance of aNorth Bend Police Officer, an Oregon State Trooper, a Coos Bay Police Officer, and a Coos County Deputy, SCINT conducted surveillance and determined Luck’s location. It was further determined Luck posed a significant officer safety risk. Through the combined surveillance, informants and technological investigation, SCINT detectives obtained a warrant. On November 11th, 2014 assisted by the Coos County Emergency Response Team, the Oregon State Police S.W.A.T. SCINT apprehended Luck at the Seven Devils Road location and taken into custody. Luck was again found in possession of methamphetamine and appeared the minor was again exposed to these conditions; case pending. Luck plead guilty to the 2013 Unlawful Delivery of Methamphetamine, Unlawful Possession of Methamphetamine, Child Neglect in the First Degree, Endangering the Welfare of a Minor, and Failure to Appear in the First Degree. Pursuant to Oregon Sentencing Guidelines, Luck was sentenced to a total of thirty-seven month in custody, followed by thirty-six months post-prison supervision.
