NB Planning Commission – California Boat Ramp, July 17

REQUEST TO AUTHORIZE REDEVELOPMENT OF THE EXISTING CALIFORNIA AVENUE BOAT RAMP AND DOCK RECREATIONAL FACILITY. The City Planning Commission held a public hearing on this application at their regular meeting on Monday, July 15th, 2019 in the City Hall Council Chambers. The applicant and staff presented the proposal including staff report and findings. There was no public comment or testimony presented for consideration in this case. Action: The Planning Commission closed the hearing and voted unanimously (4-0) to APPROVE the application based on the information  presented by the applicant and the responses and findings in the Staff Report and proposed Final Order, with those conditions of approval set forth therein, enumerated as numbers 1 through 3. Criteria and Standards: The  applicable  criteria  for  the  application  are  found  within  North  Bend  City  Code Chapters: 18.60  NBCC,  Conditional  Uses;  18.04  NBCC,  General  Provisions;  18.44 NBCC, Heavy Industrial  Zone  M-H;  18.48  NBCC,  Floodplain  Zone  F-P;  18.50  NBCC,  Tsunami  Hazard Overlay Zone; 18.68 NBCC, Off-Street Parking and Loading; 18.88 NBCC, Coos Bay Estuary Management Plan Units 44-UW and 44-DA; 18.92 NBCC, Administration, Enforcement, and Interpretation; City of North Bend Parks and Recreation Master Plan. All  land  use  decisions  are  subject  to  Oregon  Statewide  Planning  Goals,  the  City  of  North  Bend Comprehensive Plan Provisions and Policies, and applicable City Functional Plans. Decision Criteria and Findings: In  making  their  decision,  the  Planning  Commission  relied  upon  the  staff  responses  and  findings contained within the Staff Report and Final Order, the application, and the testimony and evidence presented at the Planning Commission hearing. CUP 12-19.  Validity of a Conditional Use or a Variance Permit: 18.92.040 Time limit on a permit for a conditional use or a variance.  Authorization of a conditional use or variance shall be void after twelve months from the date the decision was final unless the conditional use or variance has been implemented or a building permit has been issued and substantial construction has taken place. However, the final granting authority of the permit (planning director, planning commission or city council) may authorize a one-time extension of the permit for an additional twelve months upon request from the applicant or their authorized representative, provided the request for an extension is submitted, along with the appropriate fee, to the planning department prior to the expiration date of the original permit. (Ord. 1952 § 1(4), 2006)APPEAL PROVISIONS: A decision by the Planning Commission may be appealed by an affected party to the North Bend City Council. The appeal must be filed with the City Recorder within ten (10) calendar days from the date the decision is mailed.
