The State of Oregon has abandoned its efforts to pursue criminal charges against D.B. Western, Inc., and its founder, Dennis Beetham, based on accusations made by Mr. Beetham’s ex-wife that the company had stored and disposed hazardous waste on the Beethams’ property in Crook County. After losing several pretrial motions and a subsequent appeal, the State asked the Crook County Circuit Court to dismiss the case in its entirety, freeing the defendants from all liability in that case. A copy of the Amended Judgment to Dismiss in Crook County Circuit Court Case No. 09-FE0129 is attached.

 

That state court judgment follows an earlier federal court judgment dismissing similar charges brought by the U.S. Attorney’s office in Portland. After preliminary oral rulings by the U.S. District Court Judge favoring D.B. Western, the U.S. Attorney voluntarily dismissed all charges against the company and Mr. Beetham with prejudice, freeing the defendants from all liability in that case.
